"If a man has sexual intercourse with a woman who is a slave designated for [another] man, but she has not been redeemed or given her freedom, there must be punishment. They are not to be put to death, because she had not been freed.

Then the elders of that city will take the man and punish him.

If the guilty party deserves to be flogged, the judge will make him lie down and be flogged in his presence with the number [of lashes] appropriate for his crime. He may be flogged with 40 lashes, but no more. Otherwise, if he is flogged with more lashes than these, your brother will be degraded in your sight.
